Abstract

The Cuban Democracy Act (CDA) was enacted on October 23, 1992 by President George Bush. It contains various facets that are part of the policy of the United States towards Cuba. These include the authorization of telecommunications and direct mail services to Cuba, sanctions against the countries that provide assistance to Cuba, the prohibition of trade by North American subsidiaries and the inclusion of ships that dock in Cuban ports on a black list. This paper analyzes the component of the Cuban Democracy Act that relates to trade through subsidiaries, which is the most contentious of the law.
