Abstract

This paper addresses the evidentiary difficulties that most cases offences against women raise. For such a goal it considers the different evidence and proof stages and the effect that the so-called “gender perspective” as methodological tool could have in each of them. In that context, this work analyses some proposal to mitigate the problems found, without give up some guarantees such as the standard of proof and the exclusion of illegally obtained evidence, but making some interpretations which contribute to the success of the decision.
