Abstract

To think of the judiciary as a public power, a modification of the nineteenth century paradigm that structures the Chilean legal imaginary in its origins and for whom the judiciary is a fundamentally subordinate organ, should lead us to emphasize the importance that the judiciary exercises its powers by looking at the social context and trying to enhance access to justice. The case “Pharmacies Collusion” exemplifies these needs.
