Abstract

The article explores the relationship between the institutional notion of innocence in the criminal process and the reasoning developed in a probatory context. The central thesis is that the presumption of innocence is the ground upon which the judge reason in the moment of adjudication in criminal process, assuming the application of some standard of proof.
