The recently introduced concept of "Necessary Adequacy" in the ongoing labor reform represents an important interpretative challenge. In order to obtain a resolution to this problem, the fundamental rights in conflict of both striking workers, non-strikers, employers and the general public are analyzed. All of this together with the study of the Spanish experience in relation to the right to strike and the prohibition of replacing strikers. Finally, a critical revision of the reform and a solution are proposed
