The present article seeks to develop the concept of the objective dimension of fundamental rights and how this dimension becomes a criterion of material legitimacy
in the constitutional rule of law. Forward, the article analyses two Constitutional Court’s decisions which endorse this criterion in relation with (1) the legislator; (2) as an argument in favor of the necessity of constitutional jurisdiction; and (3) as a limit in the efficacy of fundamental rights.
